Terms of Service

These Terms of Service (the "Terms") are a binding agreement between you and LetsMap ("LetsMap", "we", "us", "our"), which operates the LetsMap application and website (the "Service"). By creating an account or using the Service, you agree to these Terms. If you don't agree, don't use the Service.

Heads up: Sections 9 (Disclaimer) and 10 (Limitation of Liability), and Section 13 (Dispute Resolution — Arbitration & Class-Action Waiver) affect your legal rights. Read them.

LetsMap is a personal calibration-tracking tool that lets you record expectations, later record outcomes, and review how your confidence aligned with reality. The Service is provided for personal self-reflection only. It is not financial, medical, legal, psychological, or professional advice of any kind.

You retain ownership of everything you enter into LetsMap ("Your Content"). You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and transmit Your Content solely to operate and improve the Service for you. We do not claim ownership of Your Content and we do not sell it.

You represent that you have the right to post Your Content and that doing so does not violate any third-party right. You are responsible for Your Content.

By creating an account you agree to receive service-related emails (password resets, security notices, receipts). Marketing and optional emails (digest, nudges, reminders) are opt-in and can be disabled at any time one-click from any email footer or in Settings → Email notifications. We comply with the US CAN-SPAM Act and the EU ePrivacy Directive.

7. Third parties

The Service may link to or integrate third-party services (e.g. Stripe, email providers). We are not responsible for third-party content or practices. Your use of those services is governed by their terms.

8. Intellectual property & DMCA

The Service, including its source code, design, copy, and trademarks, is owned by LetsMap or its licensors. You receive only the limited right to use the Service per these Terms.

If you believe content on the Service infringes your copyright, send a DMCA notice to support@letsmap.me including: (i) your signature, (ii) the work infringed, (iii) the URL of the infringing material, (iv) your address and phone, (v) a good-faith statement, and (vi) a statement under penalty of perjury that the information is accurate and you are authorized to act.

9. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, ACCURATE, OR ERROR-FREE. LETSMAP IS NOT A SUBSTITUTE FOR PROFESSIONAL ADVICE, AND YOU SHOULD NOT RELY ON IT FOR DECISIONS WITH LEGAL, FINANCIAL, MEDICAL, OR SAFETY CONSEQUENCES.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LetsMap AND ITS OWNERS, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES; FOR LOST PROFITS, LOST REVENUE, LOST DATA, OR BUSINESS INTERRUPTION; OR FOR ANY DAMAGES EXCEEDING, IN THE AGGREGATE, THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) US $100.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages; in those jurisdictions the above limitations apply to the fullest extent permitted by law.

11. Indemnification

You will defend, indemnify, and hold harmless LetsMap from and against any claim, loss, damage, or expense (including reasonable attorneys' fees) arising out of or related to (a) Your Content, (b) your use of the Service in violation of these Terms or of law, or (c) your infringement of any third-party right.

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your account at any time, with or without notice, for any breach of these Terms or for conduct we reasonably believe could harm us, other users, or third parties. On termination, Sections 4, 8, 9, 10, 11, 13, and 14 survive.

13. Dispute resolution — informal resolution, arbitration, class-action waiver

Talk to us first. Before filing anything, email support@letsmap.me describing the dispute and a proposed resolution. We'll try in good faith to resolve it within 60 days.

Binding arbitration. If we can't resolve the dispute informally, you and we agree that any controversy or claim arising out of or relating to these Terms or the Service will be resolved by final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will take place in New York County, New York (or remotely, at your option), and judgment on the award may be entered in any court of competent jurisdiction.

Class-action waiver. YOU AND WE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF A CLASS PROCEEDING. If this waiver is found unenforceable, then the entirety of Section 13 is null and void, but the rest of these Terms remain in force.

Opt-out. You may opt out of this arbitration agreement by emailing support@letsmap.me within 30 days of creating your account with the subject line "Arbitration Opt-Out". Opting out doesn't affect any other provision of these Terms.

Exceptions. Either party may bring a claim in small claims court, or seek injunctive relief for intellectual-property infringement or unauthorized access to the Service, without first going to arbitration.

14. Governing law

These Terms are governed by the laws of the State of New York, USA, without regard to conflict-of-laws rules, except that the Federal Arbitration Act governs the interpretation and enforcement of Section 13. For any dispute not subject to arbitration (e.g. injunctive relief), the parties submit to the exclusive jurisdiction of the state and federal courts located in New York County, New York.

15. Changes

We may update these Terms. If we make material changes, we will notify you by email or by posting a notice on the Service at least 14 days before the new Terms take effect. Your continued use after the effective date constitutes acceptance.
